General provisions

1. Rental certificate
Your booking confirmation confirms the rental agreement between the tenant and owner, as arranged by BORNHOLMTOURS and the corresponding arrangement between the tenant and owner. The rental agreement covers the tenancy of the holiday rental mentioned in the booking confirmation with specifications.

 

2. Booking and payment
The booking is binding when the 1. instalment is paid. The 1. instalment (25% of the price) must be paid within 10 days of placing the order. The balance is due to be paid to BORNHOLMTOURS no later than 60 days prior to arrival, whereupon tickets will be sent out. When booking later than 60 days prior to arrival, the entire price of the trip must be paid with the booking, unless otherwise agreed. Payment assumes the customer to have accepted the specified requirements for the booking listed in the catalogue for the journey. The final rental documents with specified information and conditions are applicable to the agreement. It is for the customer to verify the accuracy of the final rental documents. Any errors and misinterpretations should be clarified immediately. Special agreements must be stated in the confirmation to be valid.

 

3. Prices
The prices listed in this catalogue are fixed until new price lists are issued. Prices are subject to price and tax rate adjustments, miscalculations and errors. Combination supplements/transport prices in the catalogue supplement are valid until the specified ticket category is sold out at the individual departures. All information is given in good faith, and BORNHOLMTOURS is without legal responsibility. All prices with sign DKK are Danish Kroner (DKK Currency).

Only applies to object no. < 10000:
Where not otherwise indicated, energy consumption must be settled prior to departure by BORNHOLMTOURS. When renting a holiday home, linen, towels and tea towels must be brought along or can be pre-ordered from BORNHOLMTOURS.

Only applies to object no. > 9999:
Specified, additional charges may be added for energy consumption, bed linen etc. If tenants use site facilities, for example tennis court, sauna, solarium, etc., charges for this must be paid directly at the accommodation. Please note that off-season service functions on accommodations may be lesser than in high-season.

 

4. Insurance
All prices for holiday homes (with object no. <10000) and camping cabins are set including a 5% compulsory insurance. The compulsory insurance covers the following: "Cancellation and Household Contents Insurance" Insurance Regulations no. 391A of the European Travel Insurance A/S, Frederiksberg Allé 3, 1790 Copenhagen V., 'Extended liability' and payment to the Danish Travel Guarantee Fund. The premium of 5% of the rental fee is not refundable in case of cancellation. BORNHOLMTOURS assumes no liability. In connection with the signed rental agreement and the mandatory cancellation and Household Contents Insurance, there is no insurance to cover personal injury or property damage that may occur to the tenant and his companions during the rental period. Damage caused by tenants will be charged DKK 500 per. damage. The tenant is liable for everything belonging to the holiday home and must compensate all damages incurred during the rental period, on the holiday home and its furniture. Upon discovering damage on the holiday home or furniture, the tenant must immediately notify BORNHOLMTOURS and resort. All damages must be compensated before departure. Damages discovered after the tenant's departure will be remedied at the tenant's expense. The tenant is not relieved from payment, even though force majeure (war, strikes, natural disasters, nuclear fallout, cancellations and the like) may prevent tenant from exercising his right of use.

 

5. Health insurance
The National Health Service in Denmark includes travel insurance. A valid insurance card must be brought. The public health insurance does not cover holiday travel of more than 1 month’s endurance as well as business trips, for which special travel insurance is required.

 

6. Passport, visa, vaccinations
Nationals of the Nordic countries can travel freely between Denmark, Sweden, Norway, Finland and Iceland. Nationals from other countries must meet domestic travel regulations concerning passports, visas, vaccinations, etc. The customer is urged to investigate this with their own authorities, as there may be deadlines for the acquisition of passports and fulfilment of any health requirements. The customer must arrange for the necessary passports, visas, vaccinations, etc. to be in order before the journey.

 

7. Reservations
BORNHOLMTOURS is acting only as an agent for the used transport companies, hotels and other businesses with which it cooperates, and assumes no responsibility for changes, delays, strikes, cancellations or the like beyond BORNHOLMTOURS’ control. BORNHOLMTOURS is not liable for breaches of contract by these companies, nor by breaches of contract by owners of the rental homes. BORNHOLMTOURS is to consider only as an intermediary between a holiday home and its tenants, and is not financially responsible for disputes between the parties. For travel by ferry, liability lies with the individual line of carriage, which is limited from liability under the Athens Convention.

 

8. Pets
Pets are not allowed in the holiday home without permission and BORNHOLMTOURS must always be notified. Where it is allowed to bring pets, the authorization is for only 1 pet. Bringing livestock where it is not allowed is considered as breach of contract and will result in immediate expulsion from the property.
Danish, Swedish and Norwegian dogs and cats can be included to and from Bornholm in transit between Helsingborg and Ystad and through Lernacken/Øresund bridge-Ystad. It requires the owner's guarantee that a number of requirements from the Swedish authorities are respected. The rules are set by a form of Statens Jordbruksverk in Jönköping. Transiting of dogs and cats from countries other than Denmark, Sweden and Norway, as well as imports for longer stays, require animal passports, various tests and certificates. 9. Rental agreement
The leasing terms account for the accommodation listed in the booking confirmation and for all its amenities. The descriptions of the holiday homes are made by BORNHOLMTOURS to the best of its ability, with liability for BORNHOLMTOURS if amends have been made. The tenant is, where specified, contractually obliged to clean the premises and must at the end of the lease leave it in a clean and tidy condition. If extra cleaning is necessary, it will be carried out at the cost of the tenant. The lease applies for the specified time stated in the booking confirmation. Location of key collection/reception for the holiday home is individual and is clearly stated in the booking confirmation. If ferry tickets are ordered through BORNHOLMTOURS, the tenant must no later than 8 days prior to arrival notify BORNHOLMTOURS of the expected arrival at the holiday home. If the accommodation is booked by a group, school, institution or the like, BORNHOLMTOURS must be notified before the booking is completed and the name of the group, school, institution or the like must be stated on the rental certificate.

Only applies to object no. < 10000: The lease starts on arrival day no earlier than at 15:00 h and ends on the day of departure no later than 10:00. Key collection is made on the day of arrival no earlier than 15:00 h.

Only applies to object no. > 9999: Time of check-in/key collection is stated in the rental agreement.

 

10. Complaints
Any complaints must be made to BORNHOLMTOURS within reasonable time after the alleged error is discovered and at the latest 48 hours after it occurred. The tenant is required to grant BORNHOLMTOURS a reasonable period of time to correct any errors and to assist in avoiding further deterioration of injuries to minimize losses for BORNHOLMTOURS. If repairs are not satisfactory, BORNHOLMTOURS must be notified immediately. In cases of temporary malfunction in technical installations, like washing machine, dishwasher, TV sets, heating and similar, BORNHOLMTOURS offers no form of compensation or reduction in the rental price. Possibly odours caused by nature, for example washed-up seaweed, does not give any form of compensation or reduction in the rental price. Please note that resort areas also contain permanent habitation, and there may at times be construction work and traffic, for which there will be no compensation or reduction in the rental price. Noise due to activities (shooting, etc.) taking place in the military shooting range Raghammer will not give any form of compensation or reduction in the rental price. By not submitting a complaint claim, the tenant loses all rights to compensation. All claims invoked against BORNHOLMTOURS are regulated by Danish Law and will be submitted within reasonable time to BORNHOLMTOURS' jurisdiction, namely the court in Rønne.

Only Applies to object no. > 9999:
Tenants must also notify the house owner or its representative about errors and faults in the accommodation, so that it will be possible two remedy the error or fault as soon as possible.

 

11. Deposit
BORNHOLMTOURS can charge a deposit as a means of assurance that the property will be left clean and undamaged. Any costs for failed/inadequate cleaning and/or damages will be deducted from the deposit. Energy consumption (electricity and sometimes also water) is also deducted from the deposit.

If rental conditions have been met, and BORNHOLMTOURS has received the tenant's bank information, the deposit minus deductions will be returned about 3 weeks after your return from the holiday. If deductions exceed the security deposit the tenant will be invoiced the amount due, plus a fee of DKK 150.

 

12 Number of tenants/discounts
The accommodation may not without special permission be used by more people than the prescribed number. Number of persons is determined in the actual number regardless of age. If more people than the permitted number of people use the rental it is considered a breach of contract and the lease will be terminated immediately without further compensation to the tenant.

Only applies to object no.  < 10000:
BORNHOLMTOURS provides 20% discount on the rental price by min. 7 night stay in season period B, C and/or D in selected accommodations, and in season period II, III and/or IV for selected homes, where they are exclusively occupied by up to 2 pers. The price quoted is the actual amount, i.e. the discount has been deducted. There will be no discount for additional services such as ferry tickets or the like. If the rental is used by more than 2 persons, it is considered breach of contract and the lease will be terminated immediately without further compensation to the tenant.

 

13A. Cancellations and changes
Only apply to object no. < 10000:
Confirmed lease cannot be cancelled less than 60 days before arrival date. BORNHOLMTOURS only recognizes written notice unless otherwise agreed. Upon cancellations done more than 60 days before arrival, you will be charged an administration fee of 10% of the booking value, however DKK 500 as a minimum. Paid insurance premiums and fees are not refundable. At later cancellations the total rent will be charged if the property cannot be re-let for the same time period. In case of re-let the same rules apply as for cancelling. Rebooking/changes of rental documents and related invoices (including ferry bookings) are possible until 60 days prior to arrival for a fixed charge of DKK 200. Rebooking/changes later than 60 days prior to arrival is considered a cancellation of the confirmed booking. Later arrival or earlier return than indicated in the rental confirmation must be communicated to BORNHOLMTOURS but gives no refund. Changing of travel times must be communicated to BORNHOLMTOURS. In case of illness and death the conditions of Europæiske Rejseforsikring (travel insurance) applies.

14. Incidentally

Place of payment and venue for the tour operator is Bornholm, Denmark. Legal disputes shall be brought before the court in Rønne, Denmark.
